South Dakota has once again said no to carbon-capture pipelines.
On Monday, the Public Utilities Commission (PUC) unanimously denied Summit Carbon Solutions’ application for a state permit to install a carbon-capture pipeline across central and eastern South Dakota.
The motion came from the PUC’s lead staff attorney, Kristen Edwards, who maintained that Summit could not meet pipeline moratorium and set-back ordinances passed in four counties.

PIERRE, S.D. (KELO) — The South Dakota Public Utilities Commission has denied a permit for the Summit Carbon Solutions pipeline in the state.
It was the state commission’s first decision as the SCS hearing started Monday morning in Fort Pierre at the Casey Tibbs South Dakota Rodeo Center.
The lead staff attorney for the South Dakota Public Utilities Commission had formally requested Friday that the commission deny the application from SCS Carbon Solutions for a state permit for a proposed carbon-dioxide pipeline.

FORT PIERRE, S.D.–The South Dakota Public Utilities Commission (PUC) has voted to deny the Summit Carbon Solutions Pipeline on the first day of hearings. The proposed line would run through northeastern South Dakota.

The South Dakota Public Utilities Commission’s staff has filed a motion to deny Summit Carbon Solutions’ application to construct a carbon dioxide pipeline, citing non-compliance with ordinances in Brown, McPherson, Minnehaha and Spink counties.
The news comes after Summit withdrew its request to have the commission overrule county ordinances. Another company trying to build a carbon pipeline – Navigator CO2 – failed earlier this week to convince the commission to preempt county ordinances that impose minimum distances between pipelines, homes and other places. The commission also denied Navigator’s permit application.

PIERRE, S.D. (KELO) — The lead staff attorney for the South Dakota Public Utilities Commission formally requested Friday that the commission deny the application from SCS Carbon Solutions for a state permit for a proposed carbon-dioxide pipeline.
Attorney Kristen Edwards filed a motion that said the project no longer could meet all applicable laws and rules. Her request came one day after SCS withdrew its request that the commission pre-empt pipeline ordinances in several counties.
“It is an undisputable fact is that the proposed route currently violates county ordinances in
Brown, McPherson, Minnehaha, and Spink counties. Unless and until Summit can obtain
waivers or conditional use permits where applicable in order to bring the route into compliance, a permit cannot be granted,” Edwards stated in the motion.
