FORT PIERRE, S.D.–The South Dakota Public Utilities Commission (PUC) has voted to deny the Summit Carbon Solutions Pipeline on the first day of hearings. The proposed line would run through northeastern South Dakota.

The South Dakota Public Utilities Commission’s staff has filed a motion to deny Summit Carbon Solutions’ application to construct a carbon dioxide pipeline, citing non-compliance with ordinances in Brown, McPherson, Minnehaha and Spink counties.

The news comes after Summit withdrew its request to have the commission overrule county ordinances. Another company trying to build a carbon pipeline – Navigator CO2 – failed earlier this week to convince the commission to preempt county ordinances that impose minimum distances between pipelines, homes and other places. The commission also denied Navigator’s permit application.

PIERRE, S.D. (KELO) — The lead staff attorney for the South Dakota Public Utilities Commission formally requested Friday that the commission deny the application from SCS Carbon Solutions for a state permit for a proposed carbon-dioxide pipeline.

Attorney Kristen Edwards filed a motion that said the project no longer could meet all applicable laws and rules. Her request came one day after SCS withdrew its request that the commission pre-empt pipeline ordinances in several counties.

“It is an undisputable fact is that the proposed route currently violates county ordinances in
Brown, McPherson, Minnehaha, and Spink counties. Unless and until Summit can obtain
waivers or conditional use permits where applicable in order to bring the route into compliance, a permit cannot be granted,” Edwards stated in the motion.

SIOUX FALLS, S.D. (Dakota News Now) – Landowners are still processing the unanimous decision by the Public Utilities Commission on Wednesday to deny a CO2 pipeline in South Dakota

“All this was a victory not only for us but for all South Dakotans,” said Valley Springs resident Rick Bonander.

Bonander has dedicated many hours to speaking out against the Navigator pipeline, and the PUC’s decision on Wednesday denied their application.

Landowners weigh in on potential CO2 pipelines

SIOUX FALLS, S.D. (KELO) — The South Dakota Public Utilities Commission unanimously voted against an application to build a CO-2 pipeline through several counties on the eastern side of the state on Wednesday.

Joy Hohn owns land in Minnehaha County and is pleased with the PUC’s decision to deny the Navigator’s pipeline application, however, the Summit pipeline hearing is next week.

“I know that many landowners are sleeping much better the last few nights and continuing forward we hope that we’ll have that same result for Summit,” said Hohn.

Huron, S.D. –  September 5 the South Dakota Public Utilities Commission (PUC) rejected Navigator CO2’s application for a permit to construct the Heartland Greenway carbon capture pipeline. The company’s request sought to disregard county pipeline setback ordinances. The PUC’s unanimous decision pointed to the company’s lack of transparency in disclosing carbon dioxide plume modeling and untimely notices to landowners. The project’s intended stretch of 110 miles would have traversed eastern South Dakota including the counties of Brookings, Moody, Minnehaha, Lincoln and Turner. Similar actions have been issued in North Dakota against the foreign backed private company Summit Carbon Solutions pipeline. The PUC will make a decision regarding Summit Pipelines permit at a hearing scheduled for Monday, September 11.
